Incoming Mayor Comment—Mayor Burrell

First, I want to thank the members of my immediate family for being here with me, and for me, on this special day.

While having so many of you, my dear friends and neighbors, here with me today, makes this a very good day in my life, having my wife and the immediate members of our family here makes this a great day in my life!

Second, I want to thank you, the voters of this special township, for giving me your vote of confidence to lead our town and to represent you as your next mayor. My commitment to you is that all of my comments and actions will be tempered and guided by the constant awareness of the fact that I represent you and your town. And, that I need to implement that representation with sound judgment, with effectiveness and efficiency, and with fairness and dignity.

I also want to thank the Honorable Josh Gottheimer, our congressman and my friend, for making it a priority to be here in Vernon Township in order to play a key and essential role in my taking of the Oath of Office as Vernon’s next mayor. His respect for and the importance that he puts on Vernon Township is well noted and appreciated.

Today, January 1, 2020, marks the end of one decade and the beginning of another. It also marks the beginning of a new chapter in the life and history of Vernon Township.

And this new chapter begins with this announcement—let the word to go out from this town hall today, to friend and foe alike, that to the extent that I as your mayor can influence and control it, today marks the beginning of the end / of Vernon’s long negative political nightmare. And from this day forward, Vernon Township is open for business!

Let the word to go out from this town hall, to those individuals who are looking for a town that’s a great place to live and raise a family—that Vernon Township is open for business!

Let the word go out from this town hall, to those individuals and organizations who are looking for a town where their business can locate and prosper, and where their business will be appreciated as a valuable ratable that can help our town’s homeowners pay the tax bill for the operation of an effective and efficient municipal government—I want them to know that Vernon Township is open for business!

As I start my term as your mayor, I want to leave no doubt that my focus for the next four years will be on working with our Council, working with the Town’s Boards and Committees, working with the Town’s employees, working with the Town’s Business and Civic Groups, and working with the Town’s residents to do the hard, but always rewarding, work that’s required to enable Vernon Township to achieve its leadership potential as the largest municipality in Sussex County.

As I evaluate the challenges that we face in achieving this objective, it’s no secret that one of the key impediments is the various political, social and personality-based factions that actively and aggressively operate in our town, both in person and on social media platforms.

As I have spoken to individuals who are members of some of these factions, I have no doubt that while some have good civic intentions, much of their comments and actions have in fact served to keep our town divided and from moving forward.

I believe that it’s important from the outset that I make it clear to all individuals and factions, including those who may have supported me, that if for some reason you may have thought that I could and can be used as some type stealth weapon to get back at, to humiliate, or to somehow hurt another specific individual or faction—I want to make it clear that you were wrong. I won’t allow myself or my four years as our town’s mayor to be used in this or any other divisive manner.

I also want to confirm to those of you who thought that you could trust and believe me when I repeatedly said on the campaign trail, that if you gave me your vote of confidence to be their next mayor, that I would do everything that I could to bring our town together, and to move our town forward—I want to confirm to you that they were right to trust and believe what I said.

This attitude that I am expressing of doing what I believe to be in the best interest of our town, and not what is in the best interest of some particular individual or faction, is reflected in the approach that I have used to making my initial appointments of the professionals and the members of the various boards, committees, and commissions that provide needed services for our town.

First, you will note that at this initial stage in my administration, I have not made a lot of wholesale governmental changes. This is due to two key factors:

Factor # 1 is that my style of management is never to come into an organization like a “bull in a china shop,” and simply reck havoc on that organization, or kick people out of their jobs and positions simply because I have the authority to do so. I have learned in life that simply having the authority or being the position to do something, in itself, is not always a good, ethical, fair, or a productive reason to do a particular thing; and...

Factor # 2 is that I like to make up my own mind about the content of the character and the quality of the work of each individual and organization. And the approach that I have chosen to take at this initial stage in my administration, gives me the time and opportunity to do just that.

As I studied our boards, committees and commissions, I found that some of them have effectively and efficiently used the resources that they have been provided, and have used it in a way that has served our town well. For individuals serving on boards, committees and commissions that fall into this category, and have requested reappointment, I have overall reappointed them. In addition, where needed, I have made additional appointments to make these boards, committees and commissions even stronger.

My review also revealed that there are a few boards, committees and commissions—for example the Economic Development Advisory Committee and the Historic Preservation Commission—that needed rebuilding; that needed new life. And for boards, committees and commissions that fell into this category, I have appointed individuals who have not only committed to me that they share my vision for our town, but who also have either the experience, the training and the work ethic to ensure that the board, committee or commission to which they have been appointed plays the role that’s needed to help me move Vernon forward.

Let me digress for a few minutes and talk directly to the “fourth estate,” that is, our valued press.

I have great respect for you, the press; and believe that a society cannot be truly free without a free and inquisitive press. And I therefore don’t ask, or believe that the press should, turn a blind eye to legitimate issues for which we in Vernon Township should be held accountable.

But what I do ask of those press organizations that cover Vernon Township, is to please don’t let your coverage of our town be unduly influenced by the negative voices and actions of that small number of individuals that represent only a very small fraction of our residents.

We are in fact a good town—a good community. And I ask that you please also cover and report on those events that reflect the fact that Vernon Township is a positive force in the life of Sussex County.

Let me close by sharing with you my strong belief, and a positive belief that’s shared by a growing number of other Vernon citizens.

It is the belief that our town has an abundance of much untapped and unreleased potential. And that tapping into and releasing this potential starts with a small or large group of Vernon residents coming together, and working together to move Vernon forward.

Now I have been accused of being idealistic, and I plead guilty. For I know that every positive and great thing that humankind has ever done, has first started in the mind of an idealistic individual.

I am also an individual that’s constantly motivated by the words of the great American cultural anthropologist, author and speaker, the late Dr. Margaret Mead.

Dr. Mead once said, “Never doubt that a small group of idealistic, thoughtful and committed citizens can change things. In fact, it is the only thing that ever has.”

I am ready to change things in Vernon; I am ready to start the process of Moving Vernon Forward. I can’t do it by myself, and so I ask that you please join me!

Council Member Murphy welcomed the new Township Clerk, Marcy Gianattasio, who was appointed unanimously into the position at the December 9, 2019 Township Council meeting. Council Member Murphy said she would like to remember Council Member Dan Kadish who passed away. Council Member Murphy thanked Patrick Curreri for filling Dan Kadish’s seat for the remainder his term. She also thanked former Council Sandra Ooms for her service to Vernon Township.

Council Member Kelley Weller commented saying she is grateful to have Congressman Josh Gottheimer here to swear her in today. Council Member Weller thanked the people of Vernon Township for putting their faith and trust in her and voting her onto the Town Council.

Council Member Weller commented saying, my commitment to all of you is to work hard and to do the right thing for the town of Vernon and its residents. Council Member Weller said she is truly humbled by the outpouring of support she has already received in the past few months. Council Member Weller would like to thank her family and friends, many of whom are here today, for their continued support in the last few months even though it hasn’t been easy. Council Member Weller congratulated Dr. Burrell for his appointment as Mayor and Harry Shortway for his appointment as Council President of the Town Council. She said she is looking forward to working with both of them as well as Council Members Murphy, Auberger, and Van Tassel.

Council Member Weller commented saying, I believe together we can do great things for the town that we all love. While I know there are going to be topics we do not all agree on, I look forward to healthy debate, sharing ideas and opinions, and making decisions based on the greater good of the town and the love we have for the town and not based on personal agenda.

I thank you all again for the opportunity to serve the town that I grew up in and that I love. I look forward to many great things to come.

Incoming Council President Comments

Good afternoon to All.

Congratulations to Mayor Burrell and Councilwoman Weller.

Thank you to other members of this council.

Thank you to my family for their support.

It is an honor to be re-elected to public office. Today, I start my third term to public office. Constituents, have again provided me an opportunity serve our community.

As the former mayor, I understand the challenges of the office and the importance of the governing body. It is clear to me the majority support the following or I would not be seated here.

Vernon needs to be a destination where visitors stay overnight and entrepreneurs want to invest their dollars. Economic sustainability can be achieved by investing and developing recreation amenities and creating a unique agra/art tourism culture in concert with the resorts.

My platform is unchanged;

A recreation/art economic strategy supported by walking, hiking and biking paths connecting established trails to the resorts, the municipal complex and the town center. These pathways are in lieu of sidewalks that are absent in the Town Center.

A pump bike track and amphitheater to provide activities for residents and guests in the Town Center. We must also persist in our efforts to identify additional sources of municipal revenue other than taxpayer dollars as we did with the vacant building ordinance.

The Short Term Rental ordinance will provide additional revenue for the municipal services and recreation. I am confident the STR ordinance with changes suggested by council and members of the public will be re-introduced and adopted in the near future.

Private and public symbiotic partnerships and agreements as we entered into with Mountain Creek. We should continue efforts to attract community friendly developers by going forward with an Area in Need of Re-Development Plan.

Continue support for volunteerism.

Our revitalized recreation and beautification committees have contributed so much in the last four years to this Township.

The Greenway Action Advisory Committee dedication to Sustainable NJ and the popular Farmers’ and Holiday Markets is to be commended.

The election results also direct us to continue our efforts to protect the environment including an environmental commission who addressed local issues such as hundreds of railroad ties discarded into an environmentally sensitive area and the Silver Spruce Landfill.

We must also remain steadfast against any party who files a frivolous tort against our community. The following issues restrict our economic growth and continued effort is demanded for alternative solutions.

As reported by NJ.COM, New Jersey’s Highlands Act costs West Milford taxpayers more than a half-million dollars a year in lost revenues. WM filed a complaint to a state council that seeks to have the law declared unconstitutional.

The complaint says the Highlands Water Protection and Planning Act created “an unfunded liability...because the state legislature failed to appropriate resources to offset the permanent loss” of revenue and other hardships.

The State seized development rights without due process and compensation under the Highlands Act. Our sewer debt and restricted growth is related to state mandates.

The sewer system and associated debt is the most challenging issue facing our Township. Vernon was forced to bond millions of dollars to upgrade the SCMUA water treatment plant where waste water is processed then returned to its source aquifer.

Yet, 380,000 gallons of water flow daily from the Highlands to “down below” without compensation and is not recharged back into the source HOCs as we were required to do by the NJDEP.

We should consider joining West Milford in their efforts.

The Highlands Enterprise Zone legislation will provide some relief from the unfairness and unfunded liability caused by the Highlands Act.

In the near future I will but forth a proposal calling for a study into this dilemma to determine alternative solutions and this includes the feasibility of the Vernon MUA.

“Public comment is an absolute necessity in government,” Citizens need to be heard and to feel they are being taken seriously. They need to be allowed to speak and to get their point across.

But there are rules and I respectfully request that the public play by those rules.

Council meetings are not public forums but meetings for council business conducted in public. Public comment periods will continue as previously held. Should a member of the public present a question, I recommend that council members and/or the mayor respond if reasonable to do so during their comment section near the conclusion of the meeting or address the inquiry at the following council meeting during their comments.

All comment sections of these meetings are for expressions of opinion and not debate.

Vernon voters in 2011 approved a government change to the Faulkner Act—Strong Mayor by a 7-1 margin. Although I did not support this change I follow it because the vast majority of voters approved the referendum. Majority provides direction.

The “strong mayor” form of municipal government under the Faulkner Act provides for the direct election of the mayor, who serves a four-year term. This form is designed for a mayor to be independent of council, in charge of the administration of the municipality.

The mayor is the chief executive of the municipality and has the enforcement responsibility for all ordinances, charter provisions and prepares the budget of the municipality.

The mayor has the right to speak at council meeting but has no vote and does not need to attend.

Under this form of government, the council is the legislative body of the municipality. The council is generally limited to legislative functions, but has investigative power and may remove municipal officers for cause.

The mayor, with the advice and consent (note; not silence and dissent) of the council, appoints and removes department heads. If a council member decides not to give consent, its advice and its reasons for rejection of a mayoral appointment is subject to review by the court.

Rejection must be rational and made part of the record. The standard of review by the court is to determine if the councilmember’s rejection of the mayor’s appointment was arbitrary, capricious or unreasonable.

Should any of my council peers or the Mayor request an item be placed on the council meeting agenda, I will do so. It does not mean that I will move the respective motion or second it or vote in affirmation. All members of this council and the Mayor should have the opportunity to present legislation and/or other items for discussion in public.

Mayor Burrell’s election signifies that the public desires the infighting between mayor and council stop.

Mayor Burrell, I pledge that I will work with you. If the occasion arises that I do not agree and intend not to provide consent, I will give advance notice in an effort to open the door for discussion, hopefully leading to consensus and/or compromise.

And if my vote is nay, I will state my reasons for the record leading to my dissent.

I believe these measures will provide checks and balances in a legal, respectful and cordial manner.

And finally, I am highly confident that this Governing Body and Mayor can work together for the betterment of our community.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon that Charles G. Voelker is hereby appointed Business Administrator for the Township of Vernon effective January 1, 2020 through December 31, 2020; and

Resolution #20-02: Designation of Official Newspaper for 2020

WHEREAS, N.J.S.A. 40:53-1 et al. of the Open Public Meetings Act requires that the governing body of every municipality designate an official newspaper or newspapers for the publication of all advertisements and notices required by law to the published by the municipality; and

WHEREAS, the second newspaper designated by this body must be one which has the greatest likelihood of informing the public within the jurisdictional boundaries of this body of such meetings; and

WHEREAS, The New Jersey Herald/Sunday Herald is hereby designated to receive all notices of meetings as required under the Open Public Meetings Act and The Star Ledger, and the Advertiser News and will be designated as the alternate newspapers; and

WHEREAS, it is the opinion of this public body that The New Jersey Herald/Sunday Herald, have the greatest likelihood of informing the public within the jurisdictional area of this public body of such meetings.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon, County of Sussex, State of New Jersey that The New Jersey Herald/ Sunday Herald is hereby designated as the official newspaper for the 2020 Calendar Year and will receive all Notices of meetings of the Township Council as required by the Open Public Meetings Act, and The Star Ledger, and The Advertiser News, will be designated as alternate newspapers of the Township of Vernon.

BE IT RESOLVED, in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-1 et. seq., the Regular Meetings of the Township Council of the Township of Vernon shall convene on the Second and Fourth Mondays of each Month (except as noted with * in schedule below) at 6:00 p.m. (if there is an Executive Session), or at 7:00 p.m. (if there is no Executive Session) at the Vernon Municipal Center, 21 Church Street, Vernon, New Jersey for the following:

Formal action may be taken at any Council Meeting.

BE IT RESOLVED that all Township Council meetings shall be open to the public and public participation will be entertained at all Township Council meetings. There will be a limited period of public comment at the beginning of every meeting where speakers will be limited to three (3) minutes. During the first period for public comment each speaker may speak only on items on the current agenda. The total time for public speaking at the beginning of the meeting is limited to one half hour (30 minutes) to provide the Governing Body sufficient time to complete its work.

BE IT FURTHER RESOLVED that there will be a second period of public comment at the end of each Council meeting. Speakers will be limited to three (3) minutes where the public may speak on any topic.

BE IT FURTHER RESOLVED that all Notices required by the Open Public Meetings Act shall be published in The New Jersey Herald/Sunday Herald and, if needed, in alternate newspapers, The Advertiser News, and The Star Ledger and shall be posted on the bulletin board in the Municipal Building.

Resolution #20-04: Resolution to Adopt a Cash Management Plan-2020

BE IT RESOLVED by the Township Council of the Township of Vernon, County of Sussex, that for the year 2020, the following shall serve as the cash management plan of the Township of Vernon.

1. Cash Management and Investment Objectives

The Township of Vernon has the following objectives.

  1. Preservation of capital.
  2. Adequate safekeeping of assets.
  3. Maintenance of liquidity to meet operating needs.
  4. Investment of assets in accordance with state and federal laws and regulations.
  5. Maximize yield.

2. Designation of Official Depositories

The following Government Unit Protection Act approved banks are authorized depositories for deposit of funds:

  • Sussex Bank
  • Valley National Bank
  • Lakeland Bank
  • PNC Bank

3. Cash Management

  1. All funds shall be deposited within 48 hours of receipt in accordance with N.J.S.A.40A:5-15
  2. The Chief Financial Officer shall minimize the possibility of idle cash accumulating in accounts by assuring that any excess amounts not needed to cover expenses or in excess of negotiated compensating balances are kept in interest bearing accounts or promptly swept into the investment portfolio.
  3. Investment decisions shall be guided by the cash flow projections prepared by the Chief Financial Officer.

The Chief Financial Officer is authorized and directed to make investments on behalf of the Township. All investment decisions shall be consistent with this plan and all appropriate regulatory constraints.

6. Reporting

The Chief Financial Officer shall report to the Township Council investments in accordance with N.J.S.A. 40A:5-15.2.

7. Audit

The Cash Management Plan shall be subject to annual audit conducted pursuant to N.J.S.A. 40A:5-14.

8. Disposition of Abandoned Property

The Chief Financial Officer shall escheat to the State of New Jersey checks which remain outstanding for more than twelve months after the date of issuance.

Resolution #20-05: Reauthorizing Petty Cash Funds for Calendar Year 2020

WHEREAS, N.J.S.A. 40A:5-21 authorizes the establishment of a Petty Cash Fund in municipalities by application and resolution; and

WHEREAS, it is the desire of the Township of Vernon to establish the following Petty Cash Funds for calendar year 2020 as follows:

NOW, THERFORE BE IT RESOLVED that the Council of the Township of Vernon hereby authorizes such action and that the Township Clerk file two copies of this resolution with the Division of Local Government Services, State of New Jersey.

Resolution #20-06: Establishing Interest Rates for Delinquent Property Taxes and Assessments

WHEREAS, N.J.S.A. 54:4-67 permits the governing body of each municipality to fix the rate of interest to be charged for nonpayment of taxes or assessments subject to any abatement or discount for the late payment of taxes as provided by law; and

WHEREAS, N.J.S.A. 54:4-67 has been amended to provide an additional penalty of up to six percent (6%) on delinquent taxes and all municipal charges in excess of $10,000.00 that are not paid prior to the end of the fiscal year; and

WHEREAS, this resolution is necessary for efficient and uninterrupted operations of the business of the Tax Collector.

NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of Vernon that:

  1. The Tax Collector of Vernon Township is authorized to cancel all payments of taxes of $10.00 or less.
  2. That no interest shall be charged if payment of any installment is made within ten (10) days after date upon which the same became payable.
  3. That the rate of interest to be charged for nonpayment of taxes on or before they would become delinquent shall be 8% per annum on the first $1,500.00 of the delinquency and 18% per annum, on any amount in excess of $1,500.00, and;
  4. Interest at the rate of 8% per annum on the unpaid balance of assessment is charged with each installment on due date. Any installment not paid on or before due date is subject to 8% interest, 18% interest over $1,500.00.
  5. A Year End Penalty of 6% is hereby assessed on delinquent tax accounts in excess of the sum of $10,000.00 if a taxpayer shall fail to make payment in full on the delinquent amount prior to the end of the calendar year in which such taxes shall have accrued and been assessed.
  6. That the Chief Financial Officer of the Township of Vernon is hereby authorized to make investments for the Township of Vernon.

Resolution #20-07: Authorizing the Municipal Tax Assessor and the Special Municipal Attorney to Defend the Township before the Sussex County Board of Taxation for Tax Appeals

WHEREAS, the County Tax Board requires the governing body of each municipality to pass a resolution authorizing the Assessor and Special Municipal Attorney (for tax appeals) of the municipality to file and prosecute any and all tax appeals, farmland rollback complaints, and any added and omitted assessment complaints before the Sussex County Tax Board.

THEREFORE BE IT RESOLVED by the governing body of the Township of Vernon that the Assessor and Special Municipal Attorney(for tax appeals) are hereby authorized to file, prosecute, defend, stipulate, and/or agree upon all contested appeals before the Sussex County Board of Taxation and Tax Court of the State of New Jersey, and to initiate municipal appeals to correct the Township of Vernon tax list, including but not limited to, rollback complaints, added and omitted assessment complaints, and such other appeals as are necessary to correct property assessments for the Township of Vernon; and

BE IT FURTHER RESOLVED that the Assessor and the Special Municipal Attorney (for tax appeals) are hereby designated as the agents of the Township of Vernon for the purpose of signing settlements of the foregoing matters by stipulation.

BE IT FURTHER RESOLVED that the Municipal Clerk is directed to forward a certified copy of this Resolution to the Sussex County Tax Board.

Resolution #20-08: Appointment of Public Agency Compliance Officer

WHEREAS pursuant to the provisions of N.J.A.C. 17:27-1 the Township of Vernon is required to designate a Public Agency Compliance Officer on an annual basis; and

WHEREAS said Public Agency Compliance Officer shall act as the official liaison for all equal opportunity employment matters in the administration of public contracts; and

WHEREAS the Township designates the Township Business Administrator as the Public Agency Compliance Officer for calendar year 2020;

NOW THEREFORE BE IT RESOLVED by the Council of the Township of Vernon that it hereby designates the Township Business Administrator as the Township’s Public Agency Compliance Officer for calendar year 2020; and

BE IT FURTHER RESOLVED that the Municipal Clerk shall forward a certified copy of this Resolution to the New Jersey Department of the Treasury Affirmative Action Office as required.

Resolution #20-09: Appointing Township Business Administrator as ADA Coordinator

WHEREAS, every municipality is required to designate an ADA Coordinator; and

WHEREAS, the ADA Coordinator’s role is to ensure the Township’s compliance with the Americans with Disabilities Act.

NOW THEREFORE BE IT RESOLVED by the Council of the Township of Vernon that the Township Business Administrator is hereby appointed as the ADA Coordinator for Vernon Township.

Resolution #20-10: Authorizing Signatures on Township Checks Pursuant to N.J.S.A. 40A:5-16

BE IT RESOLVED by the Council of the Township of Vernon that the following Township Officials are hereby authorized to sign checks, withdrawal slips or other bank related items with two out of the four below listed principal signatures being required:

Resolution #20-11: Appointments of Special Police Officers

WHEREAS, pursuant to Chapter 94, Section 16 of the Code of the Township of Vernon, the Mayor shall appoint Class Two Special Police Officers; and

WHEREAS, there exists a need for transcription services to assist in the transcription of the Council Meetings for the year 2020; and

WHEREAS, Vernon Township desires to have Irene Mills provide transcription services for the term of January 1, 2020 - December 31, 2020 with an annual stipend not to exceed $3,000.00 annually; and

WHEREAS, Signature Information Solutions also agrees to protect the information obtained and to not re-sell or re-distribute this same information or make available to a third party except as needed for the purpose of providing information for tax searches to the title industry.

WHEREAS, upon authorization, Accurate Abstracts, agrees to use this information for the sole purpose of providing tax search information to the title industry; and

WHEREAS, upon authorization, Priority Search Services, LLC, agrees to use this information for the sole purpose of providing tax search information to the title industry; and

WHEREAS, Priority Search Services, LLC also agrees to protect the information obtained and to not re-sell or re-distribute this same information or make available to a third party except as needed for the purpose of providing information for tax searches to the title industry.

Resolution #20-19: Resolution of the Township Council of the Township of Vernon, County of Sussex, and State of New Jersey Appointing Deputy Custodians of Records

WHEREAS, the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (“OPRA”), names the municipal clerk as the custodian of government records; and

WHEREAS, certain officials and/or departments receive numerous public records requests based upon the nature of their official duties and/or office; and

WHEREAS, the governing body may designate one or more deputy custodians to facilitate compliance with OPRA; and

WHEREAS, the governing body adopted the policy of Deputy Custodians of Records via Resolution 16-175 on July 25, 2016 and wishes to continue this practice; and

WHEREAS, the Township Council of the Township of Vernon has determined that it is in the best interest of the Township and the public to designate deputy custodians for specific officials and/or departments.

NOW THEREFORE IT BE RESOLVED by the Township Council of the Township of Vernon, County of Sussex, and State of New Jersey, as follows:

  1. The Police Chief is hereby appointed as the deputy custodian of records for Police Department records.
  2. The Tax Collector is hereby appointed deputy custodian of records for tax collection records.
  3. The Tax Assessor is hereby appointed deputy custodian of records for tax assessment records.
  4. The Construction Official is hereby appointed deputy custodian of records for building, construction and land use records.
  5. The Chief Financial Officer is hereby appointed deputy custodian of records for financial records.

Resolution #20-20: Authorizing Alternative Prosecutor

WHEREAS, there is a need for Professional Services to the Township of Vernon for Prosecutor;

WHEREAS, the Township has appointed a Prosecutor and Public Defender for the year 2020 however the Court has recognized they may have a need for an alternate under some circumstances.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon that they hereby authorize the following Municipal Prosecutor—Peter Laemers, Esq.

Resolution #20-21: Continuation of the Beautification Committee

WHEREAS, the Council of Vernon Township established a Beautification Committee via resolution 16-66 on February 8, 2016; and

WHEREAS, the Council of Vernon Township wishes to continue the Beautification Committee consisting of seven to nine members to be appointed by the Mayor.

NOW THEREFORE, BE IT RESOLVED, by the Council of the Township of Vernon, County Of Sussex, and State Of New Jersey, as follows:

1. The Beautification Committee established via Resolution No. 16-66 on February 8, 2016 is hereby continued.

Resolution #20-23: Continuation of the Economic Development Advisory Committee

WHEREAS, the Council of Vernon Township established a Economic Development Advisory Committee via resolution 08-191 on October 9, 2008; and

WHEREAS, the Council of Vernon Township expanded the membership of the Economic Development Advisory Committee via resolution 09-88 to include two additional members on May 28, 2009; and

WHEREAS, the Council of Vernon Township wishes to continue the Economic Development Committee consisting of seven to eleven members to be appointed by the Mayor.

Resolution #20-24: Authorizing the Renewal of Contract for Maintaining Township Website

WHEREAS, there is a need for maintenance of the Township’s website; and

WHEREAS, Paviaweb developed and currently maintains the website; and

WHEREAS, the Business Administrator recommends the award of contract to Paviaweb.com, 14 Allen Street, Netcong, NJ from January 1, 2020, to December 31, 2020; and

WHEREAS, the contract stipulates a monthly maintenance fee of $340.00 which the Chief Finance Officer has determined and certified funds subject to the adoption of the 2020 budget.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon that they hereby authorize and approve the award of contract to Paviaweb.com, 14 Allen Street, Netcong, NJ, to provide Website Maintenance for the Vernon Township Municipal website for a term of 12 months.

Resolution #20-25: Authorizing the Award of Contract for 2020 Alternate Court Attendant for the Municipal Court in the Amount Not to Exceed $500.00

WHEREAS, there exists a need for an Alternate Court Attendant for the Vernon Township Municipal Court for the year 2020; and

WHEREAS, Magret Rodriguez and Lori Mitchener are the Township’s current independent contractor for this service and desires to continue in this capacity; and

WHEREAS, Vernon Township desires to execute a contracts with Magret Rodriguez and Lori Mitchener for a contract term of January 1, 2020 to December 31, 2020, with a total contract price not to exceed $500.00 each; and

WHEREAS, the Chief Financial Officer has certified that funds are available for this purpose subject to the adoption of the 2020 Municipal Budget.

NOW THEREFORE BE IT RESOLVED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows:

  1. The Township of Vernon is authorized to execute a contract with Magret Rodriguez, Lori Mitchener for 2020 Alternate Court Attendant for the Township’s Municipal Court.
  2. The Mayor and Municipal Clerk are hereby authorized and directed to execute a Contract with the above named individuals.

Resolution #20-26: Authorizing the Award of a Contract for 2020 between A & E Clothing and the Township of Vernon to Locate Clothing Donation Bins at Municipal Recycling Center

WHEREAS, Vernon Township has a need to contract with a new vendor to locate Donation Clothing Bins in the Vernon Township Municipal Recycling Center on Church Street for the continued service to Township residents; and

WHEREAS, Vernon Township has received a proposal from A& E Clothing, Carteret, NJ to provide Clothing Bins on Township Property and compensate Vernon Township $60.00 per month per Bin; and

WHEREAS, the Business Administrator and DPW Director recommend that Vernon Township engage with A & E Clothing Corp to provide four (4) donation bins at the Recycling Center commencing January 1 through December 31, 2020; and

WHEREAS, A & E Clothing Corp. has been collecting clothing in New Jersey for over twelve years which donations are shipped throughout the USA, Europe, Asia, Africa and South America and proceeds further support Non-Profit Organizations such as Retired Peace Officer Charity Organization and for research for Cancer, Crohn’s Disease and Sudden Infant Death Syndrome; and

NOW THEREFORE BE IT RESOLVED, by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey as follows:

  1. The Township of Vernon is authorized to engage A & E Clothing Corp. for the purpose of locating four (4) Clothing Donation Bins at the Vernon Township Municipal Recycling Center, Church Street, NJ.
  2. The Mayor and Township Clerk are hereby authorized and directed to execute Contract with A & E Clothing Corporation Corp.

Resolution #20-27: Authorize the Award of a Required Disclosure Contract with “Spatial Data Logic” for Permitting/Licensing Software

WHEREAS, the Township has a need for software use in the Planning & Zoning, Building, Administration, Fire Prevention and Assessor’s Offices for permitting, licensing, electronic maintenance of all inspection reports and transmission of monthly activity reports directly to the Department of Community Affairs; and

WHEREAS, for customer service efficiency and availability, Vernon Township has a need to utilize the Enterprise Licensing System offered by Spatial Data Logic, Somerset, NJ as a required disclosure contract pursuant to the provisions of N.J.S.A. 19:44A-20.4; for the calendar year of 2020 at a not to exceed cost of $20,150.00 for 13 user licenses.

WHEREAS, the Sean Canning, Q.P.A., has determined and certified in writing that the value of the acquisition will exceed $17,500; and,

WHEREAS, the anticipated term of this contract is for the year of 2020; and

WHEREAS, Spatial Data Logic in the aggregate is expected to provide more than the pay to play threshold of $17,500.00; and

WHEREAS, Spatial Data Logic, has completed and submitted a Business Entity Disclosure Certification and a Personal Contribution Disclosure form which certifies that Spatial Data Logic has not made any reportable contributions to a political or candidate committee in the Township of Vernon in the previous one year, and that the contract will prohibit Spatial Data Logic from making any reportable contributions through the term of the contract, and

Resolution #20-30: Resolution Appointing Risk Management Consultant

WHEREAS, VERNON TOWNSHIP (hereinafter “Local Unit”) has joined the Statewide Insurance Fund (hereinafter “Fund”), a joint insurance fund as defined in N.J.S.A. 40A:10-36 et seq.; and

WHEREAS, the Bylaws require participating members to appoint a Risk Management Consultant, as those positions are defined in the Bylaws, if requested to do so by the “Fund”; and

WHEREAS, the Local Unit has complied with relevant law with regard to the appointment of a Risk Management Consultant; and

WHEREAS, the “Fund” has requested its members to appoint individuals or entities to that position; and

Resolution #20-31: Resolution Appointing Fund Commissioner

WHEREAS, the Fund’s Bylaws require participating members to appoint a Fund Commissioner;

Resolution #20-32: Authorizing a Contract with Munidex to Maintain the Township’s Vital Statistic Software for 2020

WHEREAS, the Township of Vernon has a need to maintain its vital statistic software; and

WHEREAS, MUNIDEX, Inc. supplied the original vital statistic software to the Township and has the expertise to maintain said program; and

WHEREAS, the Chief Financial Officer recommends that the Township Council award a contract to maintain the Township’s vital statistic software to Munidex, Inc., 174 Route 17 North, Rochelle Park, NJ 07662; and

WHEREAS, the cost for this annual maintenance contract is $632.00 and there may be additional charges if on-site maintenance service is required and the Chief Financial Officer of the Township of Vernon, has certified these funds are available in account #0-01-20-120-38.

NOW THEREFORE BE IT RESOLVED, by the Township Council of the Township of Vernon, that the Mayor and Municipal Clerk are authorized to sign and accept the Software Maintenance Agreement for the year 2020 to maintain the Township’s vital statistic software in an amount of $632.00; and

BE IT FURTHER RESOLVED, that this resolution shall take effect immediately upon adoption according to law.

Resolution #20-33: Authorization to Amend the Vernon Township Personnel Policy and Procedure Manual

WHEREAS, Vernon Township had adopted a Personnel Policy and Procedure Manual in 1996; and

WHEREAS, former Resolution 12-105 made changes to amend the policy to include a section for Public Works Supervisor Personnel; and

WHEREAS, employees covered under the collective bargaining agreement at the Department of Public Works earn compensation for certain overtime accrued and increased allowances for certain items; and

WHEREAS, it is the desire of the Township of Vernon to amend this policy to ensure the supervisors receive the same compensation as the employees who are covered under a collective bargaining agreement;

WHEREAS, there exists a need to amend the Personnel Policy Procedure Manual to replace the existing portions of the Public Works Supervisor Personnel section with the following sections:

REGULAR HOURS; BREAKS
A Department of Public Works employee who is covered by this portion of the personnel manual shall follow the regular hours/breaks allotted for those employees covered by the collective bargaining agreement.

OVERTIME
A Department of Public Works employee who is covered by this portion of the personnel manual shall follow the overtime regulations set for those employees covered by the collective bargaining agreement.

SICK LEAVE
A Department of Public Works employee who is covered by this portion of the personnel manual shall follow the sick leave regulations set for those employees covered by the collective bargaining agreement.

HOLIDAYS
A Department of Public Works employee who is covered by this portion of the personnel manual shall follow the holidays allotted for those employees covered by the collective bargaining agreement.

UNIFORMS
A Department of Public Works employee who is covered by this portion of the personnel manual shall follow the uniform regulations and allowances allotted for those employees covered by the collective bargaining agreement.

DEPARTMENT VEHICLES, LICENSES AND PARKING REGULATIONS
A Department of Public Works employee who is covered by this portion of the personnel manual shall follow the vehicle, licenses, and parking regulations set for those employees covered by the collective bargaining agreement.

ALLOWANCES
A Department of Public Works employee who is covered by this portion of the personnel manual shall follow the allowances for meals and tools for those employees covered by the collective bargaining agreement.

NOW, THERFORE BE IT RESOLVED that the Council of the Township of Vernon authorizes amending the Vernon Township Personnel Policy and Procedure Manual to replace the aforementioned section for Public Works Supervisor Personnel as stated above.

NOW, THERFORE BE IT FURTHER RESOLVED that the amendment shall take effect retroactively to January 1, 2019.

Resolution #20-34: Resolution Authorizing a Sidebar Agreement with U.A.W. Local No. 2326

WHEREAS, the U.A.W. Local No. 2326 (hereinafter “UAW”), serves as the majority representative for a full-time clerical employee of the Township of Vernon (“Township”); and

WHEREAS, the Township determined the need to create a new level within the salary guide of the collective negotiations agreement between the parties for the title of Accounting Assistant; and

WHEREAS, the Township and UAW have agreed to a newly salary level and set forth the new salary guide level in the attached sidebar agreement; and

WHEREAS, UAW has ratified and executed the sidebar agreement on November 11, 2019

WHEREAS, the Township is desirous of agreeing to and ratifying the sidebar agreement; and

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon that the sidebar agreement is hereby agreed to by the Township and the Mayor is directed to execute the sidebar agreement.

WHEREAS, The Local Budget Law, N.J.S.A. 40A:4-1 et seq., provides that until the official Annual Budget for the budget year is adopted, a temporary budget not exceeding 26.25% of the total of all appropriations including appropriations for debt service, capital improvement fund, and public assistance must be adopted covering the first quarter of the fiscal year; and

WHEREAS, N.J.S.A. 40A:4-1 et seq. further provides that the governing body of a municipality must adopt by resolution within the first thirty (30) days of the budget, by affirmative vote of the full membership of the governing body, a temporary budget; and

WHEREAS, the Township Council desires to establish temporary appropriations pursuant to the Local Budget Law; and

WHEREAS, total appropriations for the 2019 Annual Budget, exclusive of any appropriations for debt service, capital improvements, and public assistance was $22,372,444.00; and

WHEREAS, up to 26.25% of total appropriations for the 2019 Annual Budget, exclusive of any appropriations for debt service, capital improvements, and public assistance is $4,855,492.00 for a total of $8,067,851.38.

NOW, THEREFORE BE IT RESOLVED by the Council of the Township of Vernon that the attached Schedule ’A’ entitled “2020 Temporary Budget” is hereby approved.

Resolution #20-37: Appointment of Chief Finance Officer

WHEREAS, N.J.S.A. 40A:9-140.10 requires that “in every municipality there shall be a chief financial officer appointed by the governing body of the municipality”; and

WHEREAS, the Township Council shall also appoint a Chief Financial Officer, who shall serve as director of the Department of Finance, in accordance with Article IX, Section 5-46 of the Township Code (Ordinance #11-21); and

WHEREAS, N.J.S.A. 40A:9-140.10 further provides that the term of office of the chief financial officer “shall be four years, which shall run from January 1 in the year in which the chief financial officer is appointed”; and

WHEREAS, the position of Chief Financial Officer requires the officer filling the position to have obtained certification from the Department of Community Affairs, Division of Local Government Services; and

WHEREAS, Ms. Bright has received her certification from the Department of Community Affairs, Division of Local Government Services effective December 5, 2018; and

WHEREAS, the Township of Vernon wishes to appoint Ms. Bright as the Chief Financial Officer; and

WHEREAS, the four (4) year term running will be from January 1, 2020 to December 31, 2023.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey, as follows:

  1. Ms. Bright’s four-year term is to commence effective January 1, 2020, in accordance with the requirements of N.J.S.A. 40A: 9-140.10, and shall continue until December 31, 2023.

WHEREAS, the Township of Vernon is required to have a certified Tax Collector pursuant to N.J.S.A. 40A:9-141; and

WHEREAS, Lisa Kimkowski is licensed by the State of New Jersey as a municipal tax collector and meets all other qualifications for the position, and was appointed as the Tax Collector to fill the unexpired term of the previous Tax Collector until December 31, 2015; and

WHEREAS, Lisa Kimkowski was appointed as the Tax Collector to fill the term January 1, 2016, until December 31, 2019 by Resolution # 16-26; and

WHEREAS, pursuant to N.J.S.A. 54:5-11, the governing body of each municipality shall from time to time by resolution, designate an official of the municipality to make examinations of its records as to unpaid municipal liens and to certify the result thereof.

NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the Township of Vernon, County of Sussex, State of New Jersey that Lisa Kimkowski is hereby appointed Tax Collector for the Township of Vernon effective January 1, 2020, until December 31, 2023; and

WHEREAS, the performance of said professional services requires knowledge of an advanced field of learning acquired by a prolonged formal course of specialized training and study as distinguished from general academic instruction or apprenticeship and training; and

WHEREAS, the Township of Vernon is desirous to enter into an agreement with these professionals as a fair and open contract pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., as amended; and

WHEREAS, the Chief Finance Officer has certified in writing that the value of the contracts are available for these purposes subject to the adoption of the 2020 Municipal Budget; and

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon that Vernon Township hereby authorizes and approves the award of contract of a Professional Service Contract to Sean Canning, MPA, QPA from The Canning Group, LLC pursuant to a non-fair and open contract pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:20-1 et seq. to provide Legal Services in accordance with the attached Contract for Professional Services.

BE IT FURTHER RESOLVED, that the award of contract shall be contingent upon the completion and receipt of the following:

  1. A fully-executed professional services contract detailing the scope of services, established fees for said professional services, mandatory Equal Opportunity Language and Affirmative Action Certificate; and
  2. New Jersey Business Registration Certificate; and
  3. Upon the aforementioned professional being a member in good standing in his respective profession.

BE IT FURTHER RESOLVED, that the Mayor and Township Clerk are hereby authorized and directed to execute, seal and deliver the attached Contracts for Professional Services on behalf of and in the name of the Township of Vernon and that the Township Clerk shall publish the award of contract as required by law within ten (10) days of passage of this Resolution.

WHEREAS, pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. and P.L.2011, c.139, the governing body may delegate the power to award purchases, contracts and/or agreements through New Jersey State Contracts and/or Purchasing Cooperatives to which the Township of Vernon is a member; and

WHEREAS, in the interest of streamlining Township operations and improving efficiency, it is the desire of the Mayor and Council to authorize the Purchasing Officer/Qualified Purchasing Agent (QPA) to approve purchases, contracts and agreements through New Jersey State Contracts and/or Purchasing Cooperatives, subject to provisions and requirements of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. and P.L.2011, c.139 below the $40,000.00 threshold in individual purchases and the aggregate as defined by N.J.S.A.40A:11-2(19);

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Vernon that the Purchasing Officer/Qualified Purchasing Agent (QPA) upon receipt of an identified need and direction from the Township is hereby authorized to approve purchases, contracts and/or agreements through New Jersey State Contracts and/or Purchasing Cooperatives to which the Township of Vernon is a member without further action from Council, provided that funds are available to cover the expenditure.

BE IT FURTHER RESOLVED, Purchase approvals made by the Purchasing Officer/Qualified Purchasing Agent (QPA) by virtue of the adoption of this Resolution shall be subject to the provisions and requirements of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. and that no amount of any contract shall be in excess of the bid threshold in a single purchase or the aggregate without express individual resolutions authorizing such cooperative purchases by contract number.

WHEREAS, there exists a need to maintain the Computer Aided Dispatch System for the Police Department for the year 2020; and

WHEREAS, Lawsoft services the Township system and has the expertise to maintain said system; and

WHEREAS, The Chief of Police recommends that the Township Council award a contract for the maintenance agreement to Lawsoft, 15 Hamburg Turnpike Suite 2, Bloomingdale NJ, 07403; and

WHEREAS, the term of the contract will be from January 1, 2020 through December 31, 2020 with a total annual contract price not to exceed $14,500; and

NOW THEREFORE BE IT FURTHER RESOLVED, by the Township Council of the Township of Vernon, County of Sussex and State of New Jersey, the Mayor, Clerk and CFO are authorized to execute a maintenance contract with Lawsoft, for maintenance of the Computer Aided Dispatch system at the Vernon Police Department for an amount not to exceed $14,500, annually.

Resolution #20-46: Authorizing the Award of Contract for Professional Services

WHEREAS, there is a need for Professional Services to the Township of Vernon for Attorneys, Auditor, Bond Counsel, Prosecutor, Public Defender, Engineer, Planner, Financial Advisor and Water Operator, and

WHEREAS, N.J.S.A. 40A:11-5 specifically exempts professional services from provisions of public bidding as provided in the Local Public Contracts Law; and

WHEREAS, said specified professional services are to be rendered or performed by a person or persons authorized by law to practice a recognized profession, and whose practice is regulated by law within the meaning of N.J.S.A. 40A:11-1 et seq., as amended; and

WHEREAS, the performance of said professional services requires knowledge of an advanced field of learning acquired by a prolonged formal course of specialized training and study as distinguished from general academic instruction or apprenticeship and training; and

WHEREAS, the Township of Vernon is desirous to enter into an agreement with these professionals as a fair and open contract pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., as amended; and

WHEREAS, the Chief Finance Officer has certified in writing that the value of the contracts are available for these purposes subject to the adoption of the 2020 Municipal Budget; and

WHEREAS, the Local Public Contracts Law N.J.S.A. 40A:11-1 et seq., as amended, requires that this Resolution be publicly advertised.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Vernon that they hereby authorize and approve the award of contracts of a Professional Service Contract pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:20-1 et seq. to provide Services in accordance with the attached Contracts for Professional Services pursuant to a non-fair and open contract to the following:

12. Township Water Operator—Agra Environmental and Laboratory Services

BE IT FURTHER RESOLVED, that the award of contract shall be contingent upon the completion and receipt of the following:

BE IT FURTHER RESOLVED, that the Mayor and Municipal Clerk are hereby authorized and directed to execute, seal and deliver the attached Contracts for Professional Services on behalf of and in the name of the Township of Vernon and that the Municipal Clerk shall publish the award of contract as required by law with ten (10) days of passage of this Resolution.

Council Comments

Council Member Murphy commented that ordinances on the agenda for introduction are made available to the public. This does not mean that the Council is for or against the ordinance. The reason to have ordinances introduced is to allow the Council to have time to discuss the ordinances and conduct business. Public comment is welcome.

Council Member Murphy explained that Boards, Committee and Commission’s meeting minutes and agendas are handled through Administration and not the Clerk’s Office.

Council Member Murphy addressed Mayor Burrell saying she welcomes his sense of speech along with some of his appointments.

Council Member Murphy said she has endured criticism and false accusations of committing crimes which are documented. When you ask residents of the town to comply, you have to understand how deep rooted some of these issues became. Council Member Murphy said she is often the subject of social media.

Council Member Van Tassel wished everyone a Happy and Healthy New Year.

Council Member Weller wished everyone a Happy New Year.

Council Member Auberger commented that he looks forward to working with the new Mayor and the Council to move forward. We have a lot to do, there are two tankers that need to be replaced and a football field that need replacement. Council Member Auberger said we need to move the town forward.

Council President Shortway commented that we are going to adopt a can do attitude, work together and get things done. He welcomes everybody and wishes everyone a Happy New Year.
