Statement of Compliance

The following statement of compliance was read by Barrie Beaver.

Pursuant to the Open Public Meetings Act, Chapter 231, P.L. 1975 adequate notice as defined in Section 3D of Chapter 231, P.L. 1975 has been communicated from the Vernon Municipal Center to the New Jersey Herald and published on January 18, 2007. Notice is also posted on the bulletin board and filed with the office of the Township Clerk.

Roll Call

The roll call of members was called and Dennis Downey, Michael Furrey, David Gornstein, and Barrie Beaver answered the call.

Open Meeting to the Public

Rich Casper residing at 40 Curtis Drive and Jerry Levy residing at 42 Curtis Drive addressed the EC regarding the Woodmont Homes restoration plan. Mr. Casper advised that the restoration plan does not accurately depict the site.

David Gornstein advised that the PB previously declined review of the Woodmont Homes application until state approvals are received.

Mr. Casper and Mr. Levy requested the EC support the Hidden Valley Homeowners at the March 14, 2007 PB meeting.

Mr. Casper also requested a review of the detention basins which are not functioning.

David Gornstein assured Mr. Casper and Mr. Levy the town is aware of the issues at the site the question remains how to resolve the issues.

Mr. Casper showed the EC the builder’s agreement dated November 8, 2004 between Woodmont Homes and Vernon Township which was valid for a building period of two years. The agreement specifically states if the project creates any condition that creates a public nuisance or hazard or in any way adversely effects the adjoining property owners the builder is in default. Mr. Casper stated the builder is in default therefore, the agreement is null and void.

David Gornstein made a motion to approve the February 27, 2007 minutes; Dennis Downey seconded the motion.

Applications Under Review

PB #10-06-14: Woodmont Homes—Revised Restoration Plan & Sealed Survey

The application was reviewed during the open meeting. The EC agreed the application should not be reviewed by the PB until the applicant receives state approvals, including but not limited to the LOI.

Planning Board Liaison Report

David Gornstein reported that the PB heard the first presentation of the Mountain Creek General Development Plan at the last PB meeting.

New Business

Letter dated February 26, 2007 from Hidden Valley, Inc. to the NJ Highlands Council

Requesting the Highlands Council remove the Hidden Valley Ski area, including the contiguous track of land known as the Upper Plateau from the Highlands Preservation Area Plan before the plan is finalized.

Letter from Kira Dacanay

Extending an invitation to the EC to attend a stream monitoring workshop hosted by the AmeriCorps NJ Watershed Ambassador Program on March 24, 2007.
